OVERVIEW

Welcome to Lil Tracker. Lil Tracker is operated by Iprotect Electronics Incorporated, a Canadian corporation based in Quebec, Canada. Throughout these Terms of Service, the terms “Lil Tracker,” “we,” “us,” and “our” refer to Iprotect Electronics Incorporated.

These Terms of Service govern your access to and use of www.liltracker.com, our online store, products, applications, support services, and related features, content, tools, and services collectively referred to as the “Services.” Our online store is hosted by Shopify, which provides the ecommerce platform that enables us to offer the Services.

By visiting, interacting with, purchasing from, or otherwise using the Services, you agree to these Terms of Service and our Privacy Policy. If you do not agree, you must not access or use the Services.

These Terms contain important information concerning product limitations, cellular and location services, warranties, disclaimers, and limitations of liability. Nothing in these Terms limits any consumer right or remedy that cannot legally be excluded or restricted.

SECTION 1: ELIGIBILITY, ACCOUNTS, AND RESPONSIBLE USE

You must be at least the age of majority in your state, province, country, or other jurisdiction of residence to purchase products or create an account. Adults may permit minor dependants to use products that the adult owns, purchases, configures, or manages, but the adult remains responsible for that use.

You agree to provide complete, current, and accurate account, billing, payment, shipping, and contact information. You are responsible for protecting your passwords, registration codes, account credentials, and access to any connected device or application.

You must use the Services only for lawful purposes and in accordance with these Terms, all applicable laws, and any instructions supplied with the product.

SECTION 2: PRODUCTS AND PRODUCT INFORMATION

We make reasonable efforts to describe our products accurately. Product colours, screen images, dimensions, interface details, packaging, accessories, and appearance may vary slightly from photographs or displays. Product features may also vary by model, software version, carrier, country, configuration, or availability of third-party services.

We may modify, improve, replace, or discontinue a product, accessory, feature, application, service, or specification at any time. Such changes do not affect orders already accepted except where a substitution is required and is permitted by law or agreed with the customer.

Battery-life figures are estimates. Actual battery life depends on signal strength, location-update frequency, calling, video use, screen use, Wi-Fi, temperature, battery age, and other operating conditions.

SECTION 3: GPS, LOCATION, ALERT, AND CONNECTED-SERVICE LIMITATIONS

Lil Tracker products are consumer location and communication devices. They are intended to provide supplemental information and assistance. They are not guaranteed life-safety systems, medical devices, professional security systems, or substitutes for responsible supervision, emergency services, medical care, or professional monitoring.

GPS and other location technologies provide estimates. Location information can be delayed, unavailable, outdated, or inaccurate because of buildings, indoor use, weather, terrain, satellite visibility, Wi-Fi databases, cellular towers, network congestion, device settings, battery condition, server availability, or other conditions outside our control.

Geofence alerts, SOS notifications, low-battery alerts, route history, remote commands, calling, messaging, fall alerts, and similar functions may be delayed, missed, duplicated, inaccurate, or unavailable. A geofence is not an immediate doorway alarm. Fall detection may fail to recognize a fall or may generate a false alert.

You are responsible for regularly testing the device, application, calling functions, location reporting, alerts, and emergency contacts. You must keep the device sufficiently charged and maintain any required cellular or data service.

Unless a product description expressly states otherwise, purchasing or using a Lil Tracker device does not establish a connection to police, fire, ambulance, a monitoring centre, or any other emergency-response organization.

SECTION 4: CELLULAR SERVICE, SIM CARDS, AND COMPATIBILITY

Many Lil Tracker products require an active and compatible SIM card, cellular plan, cellular network, and supported frequency bands. Coverage and service quality vary by carrier, country, location, building, network congestion, and device compatibility.

We do not own or operate cellular networks. We cannot guarantee that a particular carrier will activate or continue supporting a device, even where the technical frequency bands appear compatible. Carriers may change networks, coverage, provisioning practices, approved-device lists, plans, rates, features, or policies without notice.

SIM cards or service plans supplied, activated, or billed by a third-party carrier are also subject to that carrier’s terms, privacy policy, billing rules, coverage, and customer-service procedures. Unless expressly stated otherwise, Lil Tracker is not responsible for a third-party carrier’s service interruption, billing, suspension, cancellation, voicemail, roaming, network change, or provisioning decision.

Customers using a device internationally are responsible for confirming local carrier compatibility, frequency bands, service availability, roaming arrangements, and compliance with local telecommunications and privacy laws before use.

SECTION 5: APPLICATIONS, SOFTWARE, AND THIRD-PARTY SERVICES

Some features depend on mobile applications, cloud servers, mapping providers, operating-system providers, application stores, carriers, or other third parties. Availability may be affected by maintenance, technical failures, software updates, account configuration, device permissions, or third-party decisions.

We may release software, firmware, server, or application updates. You may need to install updates, restart a device, update permissions, or reconfigure settings to continue using certain functions.

Application availability, compatibility, and features may change over time. We do not guarantee indefinite support for every operating-system version, mobile device, carrier, or discontinued Lil Tracker model.

SECTION 6: PRIVACY, REMOTE MONITORING, AND LAWFUL USE

Your use of location, calling, audio, camera, video, remote-monitoring, and related functions must comply with applicable privacy, consent, recording, surveillance, employment, school, and telecommunications laws.

You must obtain all legally required permission from the device wearer and any other affected person before activating or using a feature that could capture, transmit, monitor, or record audio, images, video, communications, or location information.

You must not use any Lil Tracker product to secretly monitor, stalk, harass, threaten, impersonate, exploit, or unlawfully track another person.

Personal information collected through our Services is handled in accordance with our Privacy Policy. Shopify may also collect and process information as described in the Shopify Privacy Policy.

SECTION 7: WATER RESISTANCE AND PHYSICAL USE

Water-resistance ratings and limitations vary by product. Water resistance does not mean that a device is waterproof in every condition. Resistance may diminish through wear, damage, improper charging, open covers, chemical exposure, heat, pressure, impact, or repairs.

Follow the product-specific water-resistance instructions. Do not charge a wet device. Damage caused by use beyond the stated water-resistance limits may not be covered by warranty, subject to any rights that cannot legally be excluded.

SECTION 8: ORDERS AND ACCEPTANCE

Submitting an order constitutes an offer to purchase. An automated order acknowledgement does not necessarily mean that we have accepted the order. An order is accepted when payment has been authorized and we confirm or process the order.

We may refuse, limit, hold, or cancel an order where permitted by law, including suspected fraud, unauthorized payment, pricing or inventory errors, export restrictions, resale activity, technical errors, or inability to deliver to the supplied address.

Please review your order carefully before submitting it. We may be unable to change or cancel an order after processing or shipment has begun.

SECTION 9: PRICES, TAXES, DUTIES, AND PAYMENT

Prices, discounts, promotions, products, and availability may change without notice. The price applicable to an accepted order is the price shown at checkout, subject to correction of obvious errors as permitted by law.

Unless expressly stated otherwise, prices do not include shipping, customs duties, brokerage charges, import taxes, or other charges assessed by a government, carrier, or customs authority.

You represent that you are authorized to use the payment method submitted and that the information provided is accurate. You are responsible for applicable charges associated with an accepted order.

SECTION 10: SHIPPING AND DELIVERY

Shipping and delivery are governed by our Shipping Policy.

Processing and delivery times are estimates unless expressly guaranteed. Delays may occur because of carriers, customs, weather, holidays, incorrect addresses, remote destinations, security screening, labour disruptions, or circumstances outside our reasonable control.

Customers are responsible for providing a complete and accurate delivery address. Additional charges resulting from an incorrect, incomplete, refused, or undeliverable address may be the customer’s responsibility where permitted by law.

SECTION 11: RETURNS, REFUNDS, AND EXCHANGES

Returns, refunds, and exchanges are governed by our Return and Refund Policy.

Return authorization may be required before sending a product back. Products returned without authorization, outside the applicable return period, incomplete, damaged, or in a condition inconsistent with the published policy may be refused or subject to deductions where permitted by law.

Nothing in our return policy limits any mandatory right relating to defective, unsafe, misrepresented, or nonconforming goods.

SECTION 12: WARRANTY

Applicable Lil Tracker warranty coverage is described in the warranty information supplied with the product or published on our website. Warranty coverage may require proof of purchase, troubleshooting, return authorization, inspection, and return of the affected product.

Warranty coverage does not ordinarily include normal wear, cosmetic damage, accidental damage, misuse, unauthorized repair, incorrect charging equipment, damage outside stated water-resistance limits, carrier incompatibility, or third-party network and application failures, except where applicable law provides otherwise.

Any express warranty is provided in addition to, and not in place of, consumer rights that cannot be waived or excluded.

SECTION 13: INTELLECTUAL PROPERTY

The Services, including trademarks, trade names, logos, text, graphics, photographs, videos, software, designs, layouts, product information, and other content, are owned by or licensed to Lil Tracker and are protected by applicable intellectual-property laws.

You may use the Services only for personal, lawful, and noncommercial purposes. You may not reproduce, modify, distribute, republish, scrape, sell, exploit, or create derivative works from our content without prior written permission, except as permitted by law.

Shopify’s names, logos, products, and services are the property of Shopify. Other third-party names and trademarks belong to their respective owners.

SECTION 14: FEEDBACK AND REVIEWS

If you voluntarily submit a review, suggestion, image, video, idea, testimonial, or other feedback, you represent that you have the right to provide it and that it is truthful and lawful.

You grant us a nonexclusive, worldwide, royalty-free licence to use, reproduce, adapt, publish, translate, and display that feedback for operating, improving, and promoting the Services, subject to applicable privacy law.

We may remove content that is unlawful, misleading, defamatory, abusive, infringing, fraudulent, or otherwise inappropriate.

SECTION 15: PROHIBITED USES AND AUTOMATED ACCESS

You may not use the Services to violate any law, infringe rights, distribute malicious code, commit fraud, interfere with security, harvest personal information, send spam, impersonate another person, or disrupt another user’s access.

You may not use robots, scrapers, automated agents, data-extraction tools, or similar systems to access or interact with the Services in a manner that circumvents technical restrictions, conceals automated activity, overloads the Services, or violates our instructions or applicable law.

We may restrict or terminate access where we reasonably believe that these Terms have been violated.

SECTION 16: THIRD-PARTY LINKS AND TOOLS

The Services may include links, applications, tools, payment methods, maps, carrier services, or content supplied by third parties. We do not control those third parties and are not responsible for their content, availability, security, accuracy, or practices.

Your dealings with a third party are subject to that third party’s own terms and policies. You should review them before using the service or completing a transaction.

SECTION 17: RELATIONSHIP WITH SHOPIFY

Lil Tracker is powered by Shopify, which enables us to provide the ecommerce Services. Purchases made through our store are transactions directly between you and Lil Tracker, not Shopify.

Shopify is not responsible for our products, services, fulfilment, warranties, support, representations, or disputes with customers. To the fullest extent permitted by law, you release Shopify and its affiliates from claims arising solely from purchases or transactions between you and Lil Tracker.

SECTION 18: DISCLAIMER OF WARRANTIES

Except for express warranties and rights that cannot legally be excluded, the Services and products are provided on an “as available” and “as is” basis.

We do not guarantee that the website, application, servers, location services, alerts, calling, messaging, cellular service, or other connected features will always be uninterrupted, timely, accurate, secure, or error-free.

Some jurisdictions do not permit certain warranty exclusions. In those jurisdictions, the exclusions in these Terms apply only to the maximum extent permitted by law.

SECTION 19: LIMITATION OF LIABILITY

To the fullest extent permitted by law, Lil Tracker and its directors, officers, employees, affiliates, agents, contractors, licensors, and service providers will not be liable for indirect, incidental, special, punitive, exemplary, or consequential damages, including loss of profits, savings, data, use, business, or opportunity, arising from the Services or a product.

Lil Tracker is not responsible for losses caused by inaccurate or delayed location information, missed or false alerts, depleted batteries, lack of cellular coverage, carrier decisions, app or server unavailability, incorrect configuration, failure to maintain an active plan, unlawful use, or reliance on a product as an emergency or medical system.

Nothing in these Terms excludes or limits liability for fraud, wilful misconduct, death or personal injury caused by negligence where such liability cannot legally be excluded, or any other liability that applicable law prohibits us from excluding.

SECTION 20: INDEMNIFICATION

To the extent permitted by law, you agree to indemnify and hold harmless Lil Tracker, Shopify, and our respective affiliates, officers, directors, employees, agents, contractors, and service providers from third-party claims arising from your unlawful use of the Services, violation of these Terms, violation of another person’s rights, or use of monitoring or recording features without legally required permission.

SECTION 21: TERMINATION

We may suspend or terminate access to an account or Service where we reasonably believe there has been fraud, unlawful use, abuse, security risk, nonpayment, or a material breach of these Terms.

Provisions concerning intellectual property, privacy, disclaimers, limitations of liability, indemnification, governing law, and any provisions that by their nature should survive will continue after termination.

SECTION 22: SEVERABILITY, WAIVER, AND ASSIGNMENT

If any provision of these Terms is found unlawful, invalid, or unenforceable, it will be enforced to the maximum extent permitted, and the remaining provisions will remain effective.

Our failure to enforce a provision is not a waiver. You may not assign your rights or obligations under these Terms without our prior written consent. We may assign these Terms in connection with a merger, sale, reorganization, or transfer of our business, subject to applicable law.

SECTION 23: ENTIRE AGREEMENT

These Terms and the policies referenced in them constitute the agreement between you and Lil Tracker concerning the Services and supersede earlier communications relating to the same subject matter.

Where another published policy specifically addresses shipping, returns, privacy, warranty, or another subject, that specific policy applies to that subject. If there is an unavoidable conflict, mandatory applicable law will control.

SECTION 24: GOVERNING LAW

These Terms and any dispute relating to the Services are governed by the laws of the Province of Quebec and the federal laws of Canada applicable in Quebec, without regard to conflict-of-law rules.

Subject to any mandatory consumer right to bring a claim elsewhere, you and Lil Tracker submit to the jurisdiction of the courts located in Quebec, Canada.

SECTION 25: CHANGES TO THESE TERMS

We may update these Terms by publishing a revised version on this page. Where required by law, we will provide additional notice of material changes. The revised Terms take effect on the date stated in the updated version.
